RULE 121 - NEW TRIAL OR RECONSIDERATION
Section 1. New trial or reconsideration. – At any time before a judgment of conviction becomes final, the court may, on motion of the accused or at its own instance but with the consent of the accused, grant a new trial or reconsideration.
WHAT ARE THE REQUISITES FOR THE MOTION FOR RECONSIDERATION UNDER THIS RULE? TO FILE A MOTION FOR RECONSIDERATION, THE FOLLOWING ARE THE REQUISITES:1. There must be judgment of conviction
2. Such judgment hasn’t become final
3. The motion must be at the instance of the accused or by the court motu proprio, with the consent of the accused
